Is it greed or poor training?

You may remember back in March we wrote a post titled ‘Westminster parking, firm but fair‘, when a reader sent in some photos of a Westminster Traffic warden who was issuing parking tickets to scooters on a bay which had signs put up only a few hours earlier. That same reader has sent us in photos of an encounter with the very same over zealous warden (0869) who was spotted trying to issue PCN’s to more of our hapless two wheeled brothers and sisters. But this time he was approached by the Chairman of the No To Parking Fees campaign who felt this particular warden needed to be advised of the possibility of ending up in court for harassment (see Pissed off with your parking ticket post). Warden 0869 felt that he was untouchable and could not possibly be personally held accountable for his actions, he works for the council you know. He could be in for a rude awakening very soon.

After Warren explained to him he actually worked for NCP services, he was then asked if he thought it was fair to issue PCN’s to scooters which had been parked in bays with no signs. These were parking bays which had new signs fitted whilst their owners were at work. 0869 said that he allows no discretion in such circumstances, and the scooter owners should be aware of the charges anyway. He suggested if they parked in a bay without signs they should check the bay every few minutes, it’s their responsibility not his. Yes he really said ‘every few minutes‘, what a c*nt.

As Cllr knobcheese Chalkley always says, parking in Westminster is firm but fair. Yes especially with pricks like 0869 stalking the street of Westminster. Get this prick trained properly.

Seriously though, this is exactly the kind of behaviour Chalkley really wants, though publicly he’ll say it isn’t. At the end of the day, if only one person in that bay doesn’t challenge their PCN, then that’s another £40 for the coffers. This is what WCC are banking on, it’s all a gamble but at the end of the day, money keeps rolling in through PCN’s.

It’s about time Westminster City Council started to work for the people that bring in money to the borough, not out to line their own or some faceless American companies pockets along with their own.

That’s a case of harassment which should be taken up with the harassment lawyer of the No To Bike Parking Tax campaign. Checking the bay every few minutes where your vehicle is parked is a form of harassment and the council is liable for this. This is a great case to be reported on http://www.notobikeparkingfees.com/an-interesting-and-different-legal-attack/ and get the council to court and give them a taste of their own medicine.

I wonder which Conservative councillor or member of staff is not contributing to make Westminster Council look foolish and unprofessional.

I have had numerous spats with that exact CEO! He is a sneak, he will often wait around the corner and pounce on the unsuspecting PTW rider. He also seems to spend a lot of time loitering around motorcycle bays these days, when there are far more pressing parking contraventions happening around him. I will see if I can get any more information on this guy on record.

The council will shortly advertise in the Official Journal of the European Union for bidders for on-street Parking Enforcement, CCTV enforcement against parking and moving traffic offences, and Information and Communication Technology services in support of the parking function.
The contract start date is 1 April 2010. The Traffic Management Act 2004 (TMA) encourages local authorities to take a comprehensive approach to traffic and parking management. While the primary objective of a Civil Enforcement Officer should be to ensure parking controls are enforced in a fair, accurate and consistent manner, the TMA advocates that CEOs perform a wider role and carry out additional street management and enforcement tasks. This will not represent a significant change. CEOs already report unlicensed skips, abandoned and untaxed vehicles and the council is interested in exploring widening the scope of the service to include other on-street services such as defect reporting, low level inspections and potentially other enforcement activities, subject to further legal advice.
The core of the contract is parking enforcement, but the intention is to allow sufficient flexibility so that the council may, at a later date, and if it so decides, introduce a wider range of enforcement and reporting activities to those that CEOs currently perform. These may include: routine highway defect inspections; inspections of street based services (e.g. skips, licensed pitches, etc); and, enforcement of litter, dog fouling, dumping and utility works contraventions.
The council intends to use the competitive dialogue process to engage with bidders and learn from their experiences with other councils, receive ideas and undertake preliminary market sounding. However, it is important to note that at this point, no decisions to add any further enforcement or reporting functions to this contract have been made. The council would have to give full consideration to the HR implications, financial business case and any contracts that the council already has in place, as well as the progress of the council’s wider reorganisation, costs for additional services, and staff and union consultation, before arriving at any decision to further extend the scope of the contract beyond its core parking functions.
Integrated Street Management (ISM) colleagues may be reassured that:
1 – there has not been any decision to outsource ISM
2 – there is no certainty that ISM will be outsourced in the future
3 – ISM services will not be outsourced as at 1st April 2010.

So ISM gets outsourced sometime after April 2010 then.

Disgraceful. Westminster Council want to employ more sneaky arseholes like this bloke and yet get rid of their own dedicated workforce.

I’d rather pay more council tax and employ people under the council directly rather than have the council employ third rate contractors in order to remove them from the despicable practices they use. that way Westmionster get the actual result they want but they have someone (the contactor) to take the heat when malpractice hits the media.

I don’t want this kind of draconian control from my council let alone a hired third party dickhead being sneaky and underhanded.

Bring back city council management for city users and rate payers, lets not forget councils are supposed to work for us, we don’t have to do their bidding. We can vote for change.

Its about time all parking controll was caried out by central govenment. I live in Lambeth and belive me I only come to Westminster to work. As a biker and supporter of NoToBikeParkingFees.com I know that 0869 is not the only CEO to act illigaly.

I would like to say that most of Westminsters wardens do act fairly, althow the law is not fair when it allows someone to be given a PCN when displaying a blue disabilaty badge regardless of the circumstances disabled means disabled.

As I wrote at the begining though I don’t live in Westminster I live in Lambeth and think it is wrong that I should have to pay council tax to Westminster Council! At a recent stearing comity meeting it was reviealed that 25% of the money from PCN’s goes to the council, 75% goes to the company runing the wardens of which the wardens get a pitance. So I am paying Westminster Council Tax every time I get a PCN! I am also paying to park my motorbike because I chose not to commute by public transport. I don’t get a vote as to how that is spent because I don’t live in Westminster, so how’s that old saying go again “no taxation without representation”.
