Gerrard Place coining it in still?

We wrote a post last month about about how Westminster City Council were making a fortune out of a badly signed no right turn, the post was titled ‘WCC Parking Services, Firm, Fraud and Extortion‘. In that post we explained how one of our readers was issued with a PCN by one of Westminster’s scamera vans, which seemed to spend most of it’s working life parked up in Gerrard Place, often on a taxi stand.

Our reader explained to us how Kevin Goad (assistant Westminster parking drone) had rejected his appeal, quoting back to him a section from the Traffic Signs Regulations and General Directions 1994 (TSRGD). We looked at Kevin Goads reference in the 2002 TSRGD. This clearly states that two no right turn signs are required when the road is wider than 5 metres, which it is. Kevin Goad had left out the last part of the paragraph from the TSRGD in his reply to our reader. Why would Kevin Goad not want to quote all of the paragraph in his reply do you think?

Last week we were kindly sent a copy of an FOI answer from Westminster City Council telling us the number of PCNs issued from January 2009 until 29th June 2009 by the CCTV car and van parked in Gerrard Place. The FOI request asked for both Moving traffic Contraventions – 50 & 32. The code 32 is for failing to drive in the direction shown by an arrow on a blue sign. Even though there has never ever been one of these signs in Gerrard Place:

Imagine our astonishment to read that Westminster City Council have fined a total of 114 motorist for not obeying a sign which is not there? Do you still have any doubts that this is not a fraud?

In total 3,787 PCN’s were issued for Moving traffic Contravention 50 and for Moving traffic Contravention 32, 114 PCN’s were issued. This could well have raked in over £200,000 in fines, but how much over all the past years has this Scamera van taken from Londoners
Even after our first post about this, Westminster City Council still kept sending out their Scamera van to Gerrard Place. Obviously Kevin Goad could see nothing even morally wrong in fining motorists for what at best can only be described as very suspect signage, in that it doesn’t exist.
Our intrepid reader paid another visit to Gerrard Place after our last post was published just to make it clear to Westminster he slapped a copy of the last Nutsville post on the CCTV smart car still parked there.

Do you think Westminster City Council will be paying back any of the money taken in fines, at least for the code 32 PCN’s?
If council officers (Kevin Goad) know or knew their regimes or signing were defective, or non existent, yet they were enforced and people were fined, those involved may have, or maybe now committing an offence of malfeasance or misfeasance in public office.
Another reader has sent us his rejection to appeal from Westminster City Council’s Kevin Goad. Our reader explained to him that there was only one no right turn sign, which at the time did not have a light above the sign. This time Kevin Goad does not mention the  TSRGD, he simply dismisses the appeal saying that as the street is a two way street it does not need two signs at the exit. Yeah, right, like we’re going to believe you are fair and accurate about this. But we know Westminster will never take this to PATAS, they always pull out just in time.
This junction needs at least two signs, and the misleading ‘ahead only white arrow’ painted in the road needs to be covered up. But Westminster have wanted to keep this money making scam a secret, and continue to put their Scamera van at Gerrard Place day after day. It’s been like shooting fish in a barrel to them, this is how they really treat the hard working public of London, let’s be honest and fair Kevin, put the signs right, stop fining people for signs that don’t exist.

Where’s any Traffic Management sense in this being a No Right Turn, anyway. It’s a two way street, so cars can turn right INTO the road, yet they are not allowed to turn right OUT of it, yet exactly the same traffic would have to be negotiated! Add to this the lack of proper signage, the misleading white arrow in the road, and the continued issuing of PCNs despite it having been shown to be improperly signed (indeed, I saw the CCTV car there again on 1st July pm), it is abundantly clear that Westminster City Council’s claim of being Fair is anything but! Next time I see the CCTV van or car there, I will probably explain this to a few car drivers!

I don’t know how you would Rathbone a CCTV car but I know how you would Rathbone the no right turn sign ;)

Maybe I should take a trip down to Gerrard Place and stand in front of the CCTV car with a big board (blocking their vision) for a few hours (or until they move on).

Look, this is just a bureaucratic version of extortion plain and simple. Westminster City Council are illegally extorting money from the public, it’s as simple as that.

Latest update.

After sending my refusal to Westminster, they refused back. I have taken it to PATAS. I was told to expect the council to pull out. But they have not. They have submitted their evidence which I have received a copy of. In there, they state that the requirement for a sign on both sides of the road is a misinterpretation of the guidelines and does not apply to a no-turn sign. They state that the ahead arrow painted on the road, is a “get in lane” arrow and not indicating a turning direction or restriction. What is interesting is that the video they submitted, shows the car behind mine making exactly the same turn. Interestingly I used their evidence as counter evidence to suggest how poor the signage is if 2 cars in a row make a right turn.

I had to go for a postal hearing due to my availability and the date is set for 21st August. Although I get the impression that this is an earliest date, and it can be up to 4 months for a decision.

So Jon, what happened with your case? I’m currently being done for the exact same thing in Gerrards place.

Before finding this article, I even tried to challenge the idea that the signage is very unclear, and Westminster council refused to accept this. It’s good to know other people agree!

They are still at it. I saw the CCTV car tonight at 22h at the same spot !! i took 3 pictures if you need them. The racket goes on and on and on ……..

Couldn’t we approach said car with a 1-ton sand bag and ‘bag’ the smart car and quickly gaffa tape it on. Good luck getting out of the car or driving away…

It took a long time but I finally got the case thrown out. I am now trying to see if I can get my costs returned.

Basically the PATAS adjudicator wrote back to the council after 6 months, and seemingly taking the mick out of them by saying “You said the ahead arrow is meant to be a get in lane arrow. Can you explain its role in this junction at Gerard place?”. The council then responded shortly afterwards saying they no longer wanted to contest it!

So I have won in the sense of not paying the fine. But now I want the council to PAY ME instead! That will be true justice.

Hi there, concerning this matter, ie unlawful signage, markings, i have contacted my MP, about a number of issue’s, as it is my believe that without lawful authority to issue pcn’s, then i believe that councils are acting fraudulently with obtaining money by deception. My MP is requesting information, eveidence before he will public speak. if anyone has knowledge of unlewful signage or markings please contact
